Terms and Conditions

These terms and conditions are in addition to any terms and conditions imposed by the domain name registrar and other third party services.

Authority

Authority is hereby granted by the customer for Site Hosting UK  to act as agent and on behalf of the customer to arrange for registration of domain names ordered by the customer. This authority extends to Site Hosting UK accessing the customers domain name file (DNS record) to modify incorrect data and to manage all other aspects of the domain name including forwarding and e-mail routing at the request of the customer.

Payment and Charges

The registration fee is payable in advance of domain name registration and Registration fees are non refundable. Fees for additional services are payable within seven days of receipt of invoice.

Registration is not effective until the registration fee has been paid in full and cleared into the bank account of Site Hosting UK .

Domain Names will not be transferred or forwarded to any location other than the Site Hosting UK  holding page until full payment for all services has been received.

Site Hosting UK  reserves the right to halt the registration or transfer/release of a domain name if outstanding moneys are owed to them by the customer.

Payment for domain name registration and additional hosting services will be requested annually. Where payment is overdue more than 30 days, the services will be suspended.

We reserve the right to charge a small administration fee to transfer a domain name to another DNS or service provider.

Domain Name Registration

The customer certifies  that all details submitted in respect of a domain name registration are true and correct.

Domains are normally registered every two years. Payment for the registration service will be taken annually on a pro rata basis along with payment for any additional services.

Domain names are registered on a first come, first served basis. The availability and registration of a domain name is not guaranteed and registration is not completed until the customer receives written confirmation of the registration from Site Hosting UK .

Licensing of names to third parties

The customer remains the responsible contracting party under this agreement, even if the customer licenses the use of the domain name to a third party.

Service availability

Site Hosting UK  will endeavour to make the services available to the customer at all times although Site Hosting UK  does not guarantee the availability of services and do not accept any liability for any interruptions to the service or downtime however caused.

Site Hosting UK  reserves the right to suspend services at any time and for any reason, without notice. If suspension of services is likely to exceed a duration of 48 hours, notice will normally be provided by e-mail, fax or postal services of the reasons and intended duration of suspension although provision of such notice is not guaranteed.

Some services provided by Site Hosting UK may be operated by other service providers, suppliers or contractors of Site Hosting UK and the availability of their services is outside the control of Site Hosting UK. In the event of loss of such a service, Site Hosting UK will endeavour to supply an equivalent service as soon as possible.

Spamming

The customer must not participate in the practice of E-mail Spamming. Such practices will result in the suspension of their services.

Hosting

Site Hosting UK  is not responsible for the content of its servers nor for the content of any of the web sites hosted on its servers and no liability is accepted by Site Hosting UK for any copyright infringement or use of trademarks or any other information stored on our servers by a customer or third party. Site Hosting UK is not liable for any loss or damages of any data, files or software stored on our servers.

The customer is advised that Site Hosting UK  does not allow the distribution or storage of copyright material on our servers including, but not limited to, MP3 audio recordings, audio, video and photographs.  Site Hosting UK  does not allow Adult or pornographic material to be stored on our servers. we reserve the right to examine the content of material on our servers at any time and without notice.

Domain Redirection and Forwarding

At the request of the customer and provided the necessary administration fees are paid, Site Hosting UK will set up a forwarding or re-direction service for a web site and e-mails to any web URL and e-mail account authorised for use by the customer.

Where a domain name is forwarded to a web site, e-mail account or server operated by a third party, all aspects of the content, liability and operations of the web site or server are not the responsibility of Site Hosting UK and no liability is accepted for the service availability, site or server content, or any loss or damages relating to the use of the services.

Indemnity

The Customer certifies that to the best of his/her knowledge the use of the requested domain name does not violate any trademarks, company names or other statutes. Site Hosting UK shall not have any responsibility or liability to any party where a dispute arises over the use of or rights to a domain name.

The customer indemnifies Site Hosting UK  from any legal proceedings and costs that arise as a result of the registration of a domain name, or as a result of any other service provided by Site Hosting UK .

In no event will Site Hosting UK , its executives, its employees or its contractors be liable to any party for any direct, indirect, special, punitive or consequential damages of any kind or any damages whatsoever (including, without limitation, damages for loss of data, loss of profits, business interruption and the like) even where Site Hosting UK  has been advised of the possibility of damages, and on any theory of liability, arising out of the use, reliability or performance of the services provided by Site Hosting UK .

Termination or suspension of services

In the event of a violation of any part of the terms an conditions of service, Site Hosting UK  reserves the right to suspend the service and delete or otherwise remove data from our servers.

On termination of the services at the request of the customer, Site Hosting UK  reserves the right to delete all customers data stored on our servers and will not by liable for the loss thereof. It is the responsibility of the customer to ensure that they retrieve all relevant data before terminating the service.
